Actress Kelly Rutherford has said that she was "scared to leave" her husband because he was so "angry". Rutherford, who plays New York parent Lily van der Woodsen in Us teen drama Gossip Girl, announced her separation from Daniel Giersch in January. The star was three months pregnant with her second child when she filed for divorce. Gossip Girl star Kelly Rutherford has revealed she was scared to leave her husband because he's so "litigious".
The actress was three months pregnant with her second child by Daniel Giersch when she decided to leave the German businessman after a series of professional problems put a strain on their marriage.
New mum Rutherford, who is now in the middle of a messy divorce and custody battle with her estranged husband, tells Life & Style magazine, "I found out I was pregnant, and I thought, 'Oh, maybe things will be nice, maybe it will be calm, but it wasn’t. Things only got more intense.
"He (Giersch) was very litigious. He says he’s an entrepreneur, but I think he just sues people. It was very angry (behaviour). I was kind of scared to leave."
The actress, who gave birth to baby daughter Helena Grace last month, started scheming with a close friend and the pair planned her "escape".
And now she's more than happy to be a single mum to her two kids: "A lot of great men, presidents even, were raised (only) by their mothers under those conditions. The most important thing is that the children have love and stability in their lives, whether that comes from a mother or a father."

It's crazy to think that Gossip Girl has been on summer hiatus for almost two months, yet the sun still manages to rise every morning. Two months since Serena has had the opportunity to fake-kill/fake-marry anyone. Two months since Blair has been able to plot anyone's demise. Two months since a Humphrey has been a prick, an Abrams has stormed off in righteous indignation and a Bass has smarmed everyone in his path.
I guess we have to take comfort in the fact that Nate Archibald — wherever he is, whatever he's doing — is making that one face he makes. It's the only thing that gives us hope as we wander in this gossip-less desert.
Well, that and the fact that Gossip Girl started filming its third season on Monday!

EW.com recently did a Q & A on Gossip girl,and they were able to provide us with a few little spoiler scoops on Gossip Girl's third upcoming season. They reveal that Blair is going to catch Chuck connecting with a model in the September 14th opener,but that it won't be all that it appears to be. Then they were able to give little information on Serena played by Blake Lively. They said she'll be motherless for the first couple of episodes due to Kelly Rutherford (Lily van der Woodsen) being on maternity leave.

Leighton Meester isn't the only Gossip Girl making headlines today, Gossip Mom Kelly Rutherford is back in court with her soon to be ex husband Daniel Giersch. Kelly is apparently worried that her estranged hubby might leave the country and move to Germany with the couple's two children, Hermes and Helena, so she's requested that he turn in his Visa to her lawyers within a week, reports TMZ. Apparently Daniel was planning on leaving the country and taking the kids with him, right smack in the middle of their custody battle. That's a big no-no...

Kelly Rutherford's estranged husband Daniel Giersch is fighting to spend time with his newborn daughter - asking the courts to extend his visitation rights.
The Gossip Girl star welcomed little Helena Grace on Monday night at a Los Angeles hospital.
But the tot has been thrust straight into the centre of a custody battle between her warring parents - who split while the actress was pregnant and are currently going through messy divorce proceedings.
The pair is still arguing over who will provide full-time care for its two-year-old son Hermes.
Giersch has now asked for his visitation rights with his newborn daughter to be extended, despite a judge recently ruling he can spend an hour with the tot, three times a week.
He tells celebrity blogger Perez Hilton, "We are currently negotiating how often I am allowed to go to the hospital. The only thing the judge said in court last time is that I can see my daughter three times a week for one hour."
And Giersch hopes the new arrival will mean he gets to spend more time with his son: "Kelly is not allowed to stay away from Hermes more than three hours. If that's the case she has to call me so I can take care of him.That's what the judge said."
Giersch previously claimed his estranged wife failed to inform him of Helena's birth, leaving him to read about the event on the Internet.

Kelly Rutherford's estranged husband Daniel Giersch is "sickened" he wasn't notified when the Gossip Girl star gave birth - because he only learned he was a new dad after reading the news online.
The couple has been embroiled in a bitter custody battle over their son Hermes, two, since filing for divorce in 2008 - when Rutherford was pregnant with Helena Grace, the daughter she welcomed on Monday.
The German entrepreneur maintains he was never alerted of the birth - although he insists Rutherford had agreed to contact him by phone when she went into labour.
And he was left stunned after reading Internet reports that alleged he had turned down the chance to see the new arrival in hospital.
Giersch says in a statement, "Media reports claiming that I neglected to attend my daughter's birth are total lies and fabrication.
"I was never informed by Kelly about the birth of our daughter, nor was I invited to attend. In fact, I found out about it through Internet reports like everyone else. Although this sickens me, I am of course overjoyed that our baby was born healthy.
"I would've wanted nothing more than to hold our newborn daughter for a few moments, and I only seek to co-parent both our children responsibly and with love."
Rutherford's publicist Jill Fritzo insists Giersch had been asked to come see the baby, saying, "The doctors advised that no one be in the birthing room; (Daniel) was notified when (Helena) was born and was immediately invited to come see her."

The Gossip Girl star welcomed a baby girl on Monday night at a Los Angeles hospital, according to RadarOnline.com.
It is not known if Giersch was present for the birth.
The pair filed for divorce last year and have since been embroiled in a custody battled over their two year old son Hermes.
In May, Rutherford accused her businessman ex of putting Hermes in danger by not covering the swimming pool at his home - after admitting hiring a private investigator to secretly film at the property.

Chances are the baby daddy, Daniel Giersch, was not present while Kelly was giving birth because the two are currently involved in a pretty dirty custody battle. Come this fall, Ashlee Simpson-Wentz will make her way back to the small screen for a new full-time gig on the CW's new "Melrose Place." The series, based on the drama-filled original from the '90s, which starred Heather Locklear, Marcia Cross and Kelly Rutherford of "Gossip Girl," promises to be just as scandalous as the original.
"I play the girl that's straight-off-the-bus. It's fun," Simpson-Wentz told MTV News about her character, the seemingly naive Violet Foster. "It's exciting because we don't get to see the next episode. We don't get to read the scripts until we're actually about to shoot it, and everyone is dying to know what's going to happen to their characters, so it's fun. It'll be exciting to play that arc. ... It's got good drama.
